Probate Real Estate Leads: How to Find Heirs and Their Contact Info Before They List in 2026

Finding probate leads before properties hit the market requires direct access to heir contact information, court records, and a systematic approach to outreach. Probate real estate leads offer one of the highest conversion rates in real estate because heirs face time-sensitive pressure: property taxes, maintenance costs, and court-mandated distribution deadlines create urgency that typical homeowners don't experience. The key is identifying probate cases early, locating all parties involved, and connecting before listings become public.

TL;DR

• Probate leads convert at significantly higher rates than traditional leads because heirs face financial and legal pressure to sell quickly.
• Court records, probate databases, and data aggregation services are your primary sources for heir contact information; combine multiple sources for accuracy.
• Automation tools and AI can streamline lead identification and outreach, but direct verification and personalized contact remain essential to success.

Where Probate Records and Heir Information Live

Probate information is public record, but accessing it efficiently requires knowing where to look. Each county maintains its own probate court, and while some have digitized records, others still operate on paper systems. Start by identifying probate cases in your target counties, then locate the executor or administrator name, the deceased person, and the property address.

The primary sources for this information include county probate courts, county recorder offices, and county tax assessor records. Many counties now offer online searchable databases, though interfaces vary widely. Some allow keyword search by deceased name or property address; others require in-person visits or FOIA requests. Probate filing documents typically list the executor or personal representative, which is your gateway to the decision maker.

Once you identify an estate, the next step is finding heir contact information. Heirs are not always named in publicly available probate documents; instead, you typically find the executor or administrator's name and address. From there, you can use public records databases, property records, voter registration, and business databases to trace connections. Cross-referencing multiple data sources increases accuracy and reveals additional family members or co-heirs who may not appear in the initial probate filing.

Key Data Sources for Probate Lead Development

Building a Multi-Source Verification Strategy

Relying on a single source often yields incomplete or outdated information. Instead, cross-reference at least two or three sources to verify contact details and identify all heirs. When you locate an executor's name from probate court records, use that name to search tax assessor records, property records, and public records databases. This approach reveals connected addresses, phone numbers, and email addresses that might not appear in any single source.

For example, if a probate court filing lists Jane Smith as executor, search for Jane Smith in county property records. This may reveal properties she owns personally, which can provide a confirmed residential address. Then search that address in public records aggregation services to obtain phone and email. Cross-check the address against voter registration to verify currency and accuracy. This layered approach catches errors and reveals multiple ways to reach the same person.

Pay attention to timing within probate cases. Early-stage cases, typically in the first 30 to 90 days after filing, represent the best window for outreach before heirs have decided to list through traditional channels. Cases that remain open for six months or longer suggest complications, contested wills, or disputes that may delay any real estate sale. Focus initial outreach on cases in the 90 to 180 day range, when heirs have had time to process the loss but haven't yet taken action.

Automating Identification and Initial Contact

Manual court visits and record searches don't scale. Automation tools can monitor probate filings across multiple counties and flag new cases that match your target criteria. These systems typically scan court records regularly, extract key data fields (case number, deceased name, executor, property address), and compile results into searchable databases. The most advanced systems add enrichment layers, automatically cross-referencing probate cases against tax records and property data to populate contact information.

Data enrichment services fill gaps by matching executor names against phone number and email databases, returning contact options without additional manual research. This reduces turnaround from days to minutes. An enrichment-enabled workflow can identify a probate case, extract the executor's name, find their phone number, and generate a contact list all within a single automated pass.

However, automation has limits. Executor addresses may be outdated, phone numbers may connect to relatives instead of the decision maker, and email addresses may be incorrect. Use automation to generate lead lists and initial contact attempts, but plan for manual follow-up and verification. A systematic outreach sequence starting with email or voicemail, followed by a second attempt via a different channel after three to five days, increases the chance of connection.

Legal and Ethical Outreach Considerations

Probate leads are public information, and contacting heirs or executors is legal. However, respect applies to sensitive timing. Do not misrepresent yourself or your intentions. Be direct: identify yourself as a real estate professional, explain that you specialize in estate properties, and clarify that you're offering to help with a property sale if they choose to pursue one. Many heirs are overwhelmed and grateful for guidance, while others are not interested. Either response is valid; move on without pressure.

Avoid spamming or harassment. A single email or call, followed by a second attempt days later, is appropriate. If someone asks not to be contacted, honor that request immediately. Some jurisdictions have specific regulations regarding contact with heirs in probate matters; consult local real estate associations or legal resources to confirm compliance in your area.

Do not purchase contact information from sources that claim to be private or exclusive if they're actually repackaging public data. Verify that your data sources comply with public records laws and do not violate state privacy regulations. Legitimate probate data comes from official court records or aggregators that cite court sources.

Structuring Your Probate Lead Pipeline

Successful probate prospecting requires a repeatable system. Set up a weekly or daily scan of new probate filings in your target counties. Use automation or manual review to identify cases with high-value properties or multiple heirs. Extract executor contact information and enrich it with phone and email data. Segment leads by property value, case stage, and contact method availability. Prioritize cases with confirmed contact information and properties in your ideal price range.

Create a follow-up schedule. Initial contact may happen via email with a brief introduction and offer to discuss the property. If no response after five days, follow up via phone or alternative contact method. Document all outreach attempts in a CRM to track conversion and identify which outreach channels work best for your market. Over time, this data guides resource allocation toward the most effective contact methods and timing windows.

Frequently Asked Questions

Is probate property information really public, and can I legally contact heirs?

Yes. Probate filings, court records, property ownership, and tax assessor information are all public records. Contacting heirs or executors is legal, provided you are honest about your identity and intentions and respect requests not to be contacted. However, some states have specific regulations about contact timing or methods in probate cases; consult your state real estate commission or a local attorney to confirm compliance in your jurisdiction.

What's the fastest way to get heir contact information?

Combine probate court records with automated data enrichment services. First, identify the executor or administrator name from court filings. Then use a public records aggregation service to cross-reference that name and find phone numbers and email addresses. This process takes minutes versus days of manual searching. For high-volume prospecting, subscribe to a probate-specific lead aggregator that monitors court filings and pre-enriches contact data automatically.

How long after a death should I contact heirs or executors?

Wait until probate is officially filed, which typically occurs within 30 days after death. At that point, executor information becomes public. The best outreach window is usually 60 to 180 days after filing, when heirs have had time to process the loss and face mounting costs or deadlines, but before they've committed to a listing with another agent. Earlier contact during active grief may yield less receptive responses.

What if I can't find current contact information for an heir?

Try multiple sources. Start with probate court records for the executor's address, then check tax assessor records for that name, voter registration for address confirmation, and property records for any real estate the executor owns. If the primary executor remains unreachable, look for co-executors or alternate contacts named in probate documents. Last, consider sending a letter to the address on file; while slower than a phone call, it ensures the person receives your message and may prompt them to reach out if interested.
