Tax delinquent properties in Matanuska-Susitna Borough represent opportunities for investors and owner-occupants to acquire real estate at significant discounts through the tax foreclosure process. Understanding how this system works in Alaska's largest borough by area is essential before pursuing such a purchase, as the mechanics, timelines, and legal requirements differ from standard real estate transactions.

TL;DR

  • Matanuska-Susitna Borough publishes tax delinquent property lists annually; properties enter the foreclosure process after taxes remain unpaid for a specified period, typically triggering a public sale.
  • Tax deed purchases require due diligence on title quality, property condition, and lien priority, as you acquire properties "as-is" with limited recourse against the borough.
  • Alaska's redemption period and specific foreclosure procedures mean investors must verify local requirements and deadlines through the borough assessor's office before bidding.

What Are Tax Delinquent Properties and How Do They Enter the Market?

When property owners in Matanuska-Susitna Borough fail to pay their annual property taxes, the borough assessor's office begins tracking the delinquency. After taxes remain unpaid through the notice period, the property enters a foreclosure phase. At this stage, the borough publishes a list of tax delinquent parcels, signaling that these properties will be offered for sale to recover owed taxes, penalties, interest, and administrative costs.

The borough typically publishes this list publicly, and investors or potential owner-occupants can review parcels before a scheduled tax sale. This process creates an opportunity to purchase property at a fraction of its market value, though the trade-off is reduced opportunity for inspection, financing contingencies, or title guarantees typical in conventional sales.

Key Steps in the Tax Delinquent Purchase Process

  • Obtain the current delinquent property list: Contact the Matanuska-Susitna Borough Assessor's Office or check the borough website for the most recent published list. This list identifies all parcels currently in or approaching foreclosure status.
  • Research property details: Use the borough's parcel identifier or legal description to locate the property on tax maps and assessor records. Review the property history, assessed value, owed tax amount, and any recorded liens or easements that may affect your rights after purchase.
  • Verify title and lien position: Request a title search from a title company or attorney to confirm no prior liens (mortgage, judgment, HOA) take priority over the tax lien. Tax delinquency sales are "subject to" certain prior liens; you assume responsibility for them, even if not obvious from the delinquent list alone.
  • Inspect the property if possible: Unlike MLS listings, tax delinquent properties are rarely shown by appointment. Visit the site in person to assess accessibility, visible structural condition, and environmental factors. Do not trespass on occupied properties without permission.
  • Calculate your maximum bid: Add together the owed taxes, penalties, interest, and estimated administrative costs. Consider whether the likely sale price justifies the repair and marketing effort needed to flip or occupy the property, especially in remote or rural parcels common in the Mat-Su Borough.
  • Participate in the sale or auction: Attend the public sale date announced by the borough, bring a valid form of payment (check or money order, depending on borough rules), and bid accordingly. Upon successful bid, you receive a tax deed or certificate of sale depending on Alaska's specific procedures.
  • Complete redemption and deed recording: After the sale, confirm any redemption period has expired (during which the original owner may reclaim the property), then record the tax deed with the borough recorder to establish clear title.

Common Pitfalls and How to Avoid Them

Overlooking prior liens: A tax deed purchase does not eliminate mortgages, HOA liens, or judgment liens that predate the tax lien. Before bidding, confirm whether you are buying free and clear or assuming existing debt. If a mortgage exists, the lender may foreclose after your tax purchase, leaving you with nothing but lost costs.

Underestimating repair costs: Properties in foreclosure may suffer from deferred maintenance or deliberate damage by prior owners. Budget conservatively and factor in potential environmental issues, foundation problems, or code violations. In Alaska's climate, unheated buildings can incur severe structural damage over a single winter.

Misjudging local market demand: Remote parcels in the Mat-Su Borough may be difficult to resell even at a discount. Verify that your exit strategy (rental income, commercial use, or resale) aligns with local demand before committing capital.

Missing auction deadlines or requirements: Tax sales have firm dates and strict payment rules. Missing a deadline or bringing the wrong form of payment forfeits your opportunity and any deposit. Mark important dates on a calendar and contact the borough assessor weeks in advance to confirm all procedures.

Neglecting redemption periods: In Alaska, after a tax deed sale, the original owner may have a specified period to reclaim the property by paying back taxes and costs. During this time, you hold a certificate but not a clear deed. Understand your borough's redemption laws before assuming ownership.

Financing and Payment Considerations

Most tax deed sales require payment in full at the time of purchase, typically via cashier's check or money order on the sale date. Traditional mortgage financing is rarely available for tax purchases because lenders cannot assess title quality or property condition adequately. Private lenders or hard money sources may offer short-term financing, but expect higher rates and shorter terms than conventional mortgages.

Plan to have funds ready and available; borrowing at the last minute is impractical. Some investors maintain a dedicated reserve account for tax deed opportunities, allowing them to move quickly when a promising parcel appears on the delinquent list.

Accessing Current Lists and Borough Resources

The Matanuska-Susitna Borough Assessor's Office maintains records of current tax delinquencies and publishes foreclosure notices in local newspapers or on the borough website. Contact the assessor's office directly or visit the borough office in Palmer for the most accurate, up-to-date information. Many boroughs now post delinquent lists online, though older lists may not reflect recent payments or redemptions.

Additionally, review borough tax sale procedures, timelines, and appeal processes. Alaska state law governs general foreclosure principles, but each borough implements specific local rules. Consulting a local real estate attorney or title company familiar with Mat-Su Borough tax sales can clarify your obligations and protect your investment.

Frequently Asked Questions

How do I find the current Matanuska-Susitna Borough tax delinquent property list?

Contact the Matanuska-Susitna Borough Assessor's Office directly or visit the borough website, where delinquent property lists are typically published annually or as properties become delinquent. The assessor's office can also provide historical lists and answer questions about specific parcels, owed amounts, and upcoming sale dates.

What happens if I win a tax deed auction but the property has an existing mortgage?

In most cases, you acquire the property subject to the existing mortgage. The lender may choose to foreclose after your purchase, in which case you could lose the property and your investment. Always verify lien position and title status before bidding. Some prior liens (particularly mortgages) take priority over the tax lien, meaning the mortgage holder can reclaim the property even after your tax purchase.

Is there a redemption period after I purchase a tax delinquent property in Alaska?

Yes, Alaska law typically allows original owners a redemption period during which they can reclaim the property by paying back taxes, penalties, interest, and your purchase costs. The exact length of this period varies and may depend on the specific circumstances of the foreclosure. Verify the redemption timeline with the borough assessor before assuming you have clear title immediately after the sale.

Can I finance a tax delinquent property purchase through a bank or mortgage lender?

Conventional financing is generally unavailable for tax delinquent purchases because lenders require clear title, professional appraisals, and standard underwriting, all of which are difficult to establish before a tax sale closes. Some investors use private lenders or hard money loans, which typically charge higher rates and require a larger down payment. Plan to pay in cash or arrange private financing well in advance.
