Assignment Fee Pricing: $3K to $22K by State

Key Takeaways

• An assignment fee is the profit a wholesaler earns by transferring a purchase contract to an end buyer without taking title; it equals the end buyer's price minus the contracted price (for example, $110,000 minus $100,000 is a $10,000 fee).
• Assignment fees typically range from a few thousand dollars to over $20,000 per deal, depending on after-repair value, local market conditions, property type and state regulation.
• States differ on licensing: some let unlicensed wholesalers assign contracts, others treat assignment as a real estate transaction that requires a license, so check your state's real estate commission rules before your first deal.
• A contract can be assigned only if it permits assignment; where it does not, or assignment is restricted, a double closing is the alternative.
• Assignment fees are taxable business income, and the IRS sets the self-employment tax rate at 15.3%.

An assignment fee in real estate wholesaling is the profit a wholesaler earns by transferring (assigning) their purchase contract to a buyer (typically a cash investor or fix-and-flip operator) without ever taking title to the property. The wholesaler's fee comes from the difference between the contracted purchase price and the actual price the end buyer pays. Assignment fees typically range from a few thousand dollars to over $20,000 per deal, depending on market conditions, property type, and state regulations.

Summary: how much can wholesalers charge as an assignment fee?

• Assignment fees vary widely by state, with limits and market demand ranging from roughly $3,000 to $22,000 per transaction.
• The size of your assignment fee depends on three factors: the property's after-repair value, local real estate market conditions, and whether your state regulates wholesaling.
• Some states have no legal restrictions on assignment fees, while others impose caps or licensing requirements that directly limit your earning potential per deal.

How does an assignment fee work?

In a wholesale transaction, you control a property under contract at a specific price. Rather than purchase it yourself, you find an end buyer (investor) willing to pay a higher price. The difference between your contracted price and the investor's price is your assignment fee. For example, if you contract a property for $100,000 and assign it to an investor for $110,000, your assignment fee is $10,000.

The end buyer typically covers the assignment fee as part of their total acquisition cost. From their perspective, they are paying more per unit, but they benefit from your deal-finding and negotiation work. This arrangement works only when the property's repair costs and profit potential justify the higher entry price for the investor.

What determines the size of an assignment fee?

After-Repair Value (ARV)

The higher the potential resale or rental value of a property, the larger the assignment fee can be. Properties in strong markets with significant profit margins allow investors to pay higher assignment fees while still meeting their investment returns. A property that can be repaired and resold for $250,000 supports a much larger assignment fee than one valued at $150,000.

Local Market Conditions

Markets with strong investor demand, limited inventory, and rising property values allow wholesalers to command higher fees. Competitive markets where multiple wholesalers pursue the same deals force fees lower. Geographic differences in real estate activity, availability of cash investors, and inventory levels all influence what the market will bear.

Property Type and Repair Scope

Heavily distressed properties requiring $50,000+ in repairs support larger assignment fees because investors must account for significant carrying costs and construction risk. Lightly distressed properties with predictable repair costs and faster timelines may command smaller fees because investor risk is lower.

State Regulations and Licensing

Some states impose caps on assignment fees or require wholesalers to be licensed as real estate agents. These regulatory frameworks directly limit the maximum fee you can charge. Other states have no restrictions, allowing fees to be negotiated freely between parties. Knowing your state's legal environment is essential before structuring deals.

How do assignment fees differ by state?

Assignment fee rules and market norms vary significantly across the country. Some states have clear legal boundaries, while others leave the practice entirely unregulated. The source material references a range from roughly $3,000 in lower-demand states to $22,000 in high-activity states like North Carolina and Georgia, though specific state-by-state caps are not universally standardized.

High-Fee States

States with strong real estate investor activity, high property values, and minimal regulatory restrictions tend to support assignment fees of $15,000 to $22,000 or more. These markets include North Carolina, Georgia, and parts of Texas and Florida. The combination of abundant cash investors, competitive deal flow, and favorable legal environments allows wholesalers to capture larger spreads.

Mid-Range States

Many states support assignment fees in the $8,000 to $15,000 range. These markets have active investor communities but may have moderate regulatory oversight or more limited inventory. Properties in these regions still attract sufficient investor interest to support meaningful assignment fees without hitting state-imposed caps.

Lower-Fee or Regulated States

States with stricter licensing requirements, lower investor density, or explicit fee caps may limit assignment fees to $3,000 to $8,000. Some states require wholesalers to be licensed as real estate agents and adhere to commission-based compensation structures. Arizona, mentioned in the source material, represents a market where fees may be lower due to either regulatory environment or local market conditions.

What legal rules apply to assignment fees?

Disclosure Requirements

Most states that regulate wholesaling require transparent disclosure of your assignment fee to all parties involved in the transaction. Hiding or misrepresenting your profit can expose you to legal liability. Ensure all contracts clearly identify the assignment fee amount and that parties understand the structure before signing.

Licensing and Authorization

Some states classify assignment of contracts as a real estate transaction requiring a real estate license. Research your state's licensing board requirements before conducting wholesale transactions. Operating without proper licensing where it is required can result in fines, deal cancellation, or criminal liability.

Contract Assignability

Your purchase contract must explicitly allow assignment. If the original contract with the seller prohibits assignment, you cannot legally assign it to another buyer. Always include language in your contracts that permits assignment without the seller's consent, or structure the deal as a double closing (where you take title briefly before reselling).

How can wholesalers maximize assignment fees within legal limits?

Build Your Buyer List

A robust network of active cash investors who consistently purchase properties increases competition for your deals and justifies higher assignment fees. Invest time in building relationships with local real estate investors, fix-and-flip operators, and investment companies. The more buyers interested in your deals, the more leverage you have to negotiate higher fees.

Focus on Strong Deals

Properties with clear profit potential and low execution risk command higher assignment fees. Spend effort identifying off-market deals in neighborhoods with strong investor demand. A property that offers an investor a clear $40,000 profit after all costs and your assignment fee is far more valuable than a marginal deal requiring $3,000 in assignment fee to move.

Understand Your Market's Norms

Interview successful wholesalers in your area to understand what assignment fees are typical for different property types and price ranges. Pricing too high prices you out of deals; pricing too low leaves money on the table. Market intelligence is essential for positioning your fees competitively while maximizing profit.

Consider Double Closings

In markets where assignment is restricted or heavily regulated, a double closing allows you to take title to the property and immediately resell it. While more complex and costly, this structure avoids the need to assign the contract and may allow you to capture larger profits in restricted jurisdictions.

Frequently Asked Questions

Are assignment fees taxable income?

Yes, assignment fees are taxable as business income. You must report the full amount as gross income when you file your tax return. The IRS sets the self-employment tax rate at 15.3% (12.4% Social Security plus 2.9% Medicare), calculated on Schedule SE (IRS, current guidance). If you operate as a sole proprietor, the fee is reported on Schedule C. If you operate an LLC or corporation, income is reported on the business tax return. Consult a tax professional to understand deductions, self-employment tax obligations, and entity structure options that may minimize your tax burden.

Can I assign a contract if the seller objects?

Only if your original purchase contract explicitly permits assignment without the seller's consent. If your contract requires the seller's permission to assign, you cannot proceed without their approval. Most wholesale contracts include assignment language, but you must verify this before making offers. If a seller refuses to permit assignment, a double closing is your alternative.

What is the difference between an assignment fee and a finder's fee?

An assignment fee is earned by assigning your contractual rights to an end buyer. You never take title to the property. A finder's fee is typically a flat payment for bringing a deal to an investor, often negotiated separately from the purchase contract. Assignment fees are contractually tied to the property transaction, while finder's fees are informal arrangements. Assignment fees are more structured and legally transparent.

Do I need a real estate license to collect assignment fees?

Requirements vary by state. Some states permit unlicensed wholesalers to assign contracts without a license. Other states classify contract assignment as a real estate transaction requiring a license. A few states have specific wholesaling exemptions. You must research your state's real estate commission rules or consult a local real estate attorney before starting wholesale business to ensure compliance and avoid operating illegally.
